1. Scope and acceptance
These terms govern access to the website, platform, voice runtime and AYWA services. By creating an account, subscribing or using the service, the customer accepts these terms and applicable contract documents. A signed order or agreement prevails in case of conflict.
2. Account and authority
Users must provide accurate information, protect access credentials and have authority to bind the organisation they represent. The customer manages members, roles, keys and devices and promptly informs AYWA of suspected access.
3. Configuration and customer responsibility
The customer selects agents, instructions, data, recipients, schedules, providers, numbers, integrations and actions. It must test important scenarios before production, maintain fallback procedures and ensure its configuration complies with its business, commitments and the law.
4. Acceptable use
AYWA must not be used for unlawful, deceptive, abusive or dangerous activity, to bypass consent or objections, impersonate, harass, compromise systems, collect data without authority or breach applicable telephony and outreach rules. AYWA may suspend use presenting a serious risk.
5. Plans, usage and payment
Prices, quotas, trial periods, overages, taxes and renewal terms are those displayed at subscription or agreed in writing. Third-party provider costs may be billed directly by those providers or re-invoiced under the plan. The customer remains responsible for usage generated by its accounts, keys, campaigns and integrations.
6. Data and privacy
Each party retains rights in its data and pre-existing materials. The customer authorises processing needed to provide the service and warrants that it has the required rights in submitted data. Roles, measures and transfers are described in the privacy policy and, where applicable, the data processing agreement.
7. Intellectual property and feedback
AYWA and its licensors retain rights in the platform, runtime, brands, models and documentation. The granted licence is limited to the term and scope of the plan. The customer may provide feedback; AYWA may use it to improve the service without disclosing customer confidential information.
8. Availability, support and third parties
The service may depend on third-party networks, clouds, telephony carriers and AI providers. Guaranteed support levels, maintenance windows, availability and recovery are only those stated in the plan or agreement. Without a written commitment, no availability percentage or resolution time is guaranteed.
9. Suspension and termination
AYWA may limit or suspend the service for non-payment, security risk, prohibited use, legal requirement or threat to the service. When the agreement ends, access ceases and data follows applicable export, retention and deletion terms. The customer must arrange exports before closure.
10. Liability, law and contact
Applicable exclusions, liability caps and warranties are set out in the plan or agreement and apply to the extent permitted by law. Unless otherwise agreed, French law applies. Contract contact: team@aywa.ai.
